What Is a Pour-Over Will—And Why Your Trust Needs One

Many people assume that once they've created a living trust, their estate plan is complete.

In reality, even the most thoughtfully drafted trust needs a backup plan. That's where a pour-over will comes in.

What Is a Pour-Over Will?

A pour-over will is a special type of will that's designed to work alongside your revocable living trust.

After creating your trust, you'll typically transfer ownership of major assets—such as your home, investment accounts, and certain bank accounts—into the trust. When those assets are properly titled, they can generally be managed and distributed according to your trust without going through probate.

But life rarely stands still. You might open a new bank account, purchase property, inherit assets, or simply overlook transferring something into your trust.

A pour-over will provides a safety net for those situations.

How Does It Work?

If you pass away with assets that were never transferred into your trust, your pour-over will directs that those assets be "poured over" into the trust after your death.

Once there, they're distributed according to the instructions you've already created in your trust.

Instead of having multiple plans governing different assets, your estate can ultimately be administered under one comprehensive set of instructions.

Does a Pour-Over Will Avoid Probate?

This is an important distinction.

A pour-over will does not automatically avoid probate for assets that remain outside your trust.

Those assets may still need to pass through the probate process before they're transferred into the trust.

That's why properly funding your trust—transferring assets into it during your lifetime—is one of the most important parts of estate planning.

Think of the pour-over will as a safety net, not the primary strategy.
